Kabel Deutschland: throttling terms for old contracts

Internetprovider Kabel Deutschland is currently informing customers that current terms and conditions, including Internet throttling, are also applicable to old contracts. This concerns customers who have completed their Internet contract before August 2009. To date, these have not been affected by file sharing restrictions, where increased data throughput results in a deceleration of the guaranteed surf speed to 100 kbit / s.

Currently, Kabel Deutschland reduces the Internet speed if the daily data throughput exceeds a total volume of 60 GB. In the General Terms and Conditions the Internetprovider has the right to activate the throttling already with a transferred volume of 10 GB, if mainly file-sharing applications provided for the consumption. There is no Internet traffic through surfing or streaming music or movies.

In the middle of 2017 the district court of Munich had condemned Kabel Deutschland because of misleading advertising, the reference to the throttling was not clear enough. In addition to adapting the advertisements, the provider had to pay a fine of 250,000 euros.


According to the adjusted costs of the middle of 2017, the new general terms and conditions are now also applicable to old contracts.
